BETA Software License Agreement
This agreement covers every BETA version of the Retouching Academy Photoshop panels, including the Beauty Retouch 6.0 BETA. It supplements our Software Product License Agreement and Terms & Conditions; where they differ, this agreement applies to the BETA. By adding a BETA to your Member Account, downloading, installing, or using it, you agree to these terms.

The Agreement
This BETA License Agreement (the “Agreement”) is between you and Queenscliff Global LLC, Texas (“we,” “us,” or “our”). It governs your use of any BETA version of the Retouching Academy Photoshop panels (the “RA Panels BETA”).
You receive a limited, non-exclusive, non-transferable, revocable license to use the RA Panels BETA. You are not buying the software. Queenscliff Global LLC remains its sole owner.
Please read these terms before continuing. We may change this Agreement at any time without notice, so please review it regularly for updates.

BETA Version Disclaimer
The RA Panels BETA is a preliminary release, provided for testing and feedback. It may contain bugs, errors, incomplete features, or other issues that affect how it works and performs. Features may change or be removed before the final release, and a BETA build may expire or stop working when a final version ships or a newer BETA replaces it.
The RA Panels BETA is provided strictly “AS IS,” without warranty of any kind, express or implied. You use it at your own risk. We are not liable for any loss of data, damage, or disruption arising from or connected to the BETA. Keep regular backups of your files before and during use. We may discontinue any BETA, or end your license to use it, at any time without notice. If that happens, stop using the BETA and delete it.

Eligibility & License Activation
The RA Panels BETA is available at no cost to customers who hold an active license for the corresponding RA Panel (for example, the Beauty Retouch 6.0 BETA requires an active Beauty Retouch license). The BETA activates against that license and stops working if the license lapses. Adding a BETA to your Member Account does not extend, renew, or replace the underlying license.
If your subscription lapses or is cancelled, you can renew it from your Member Account, or through our Support Team, within 30 days of that date. After 30 days, the license ends, and you will need to purchase a new license to use the RA Panels again. A Lifetime license needs no subscription and does not lapse.

Copyright
The RA Panels BETA and everything in it, including the software code, scripts, actions, brushes, tool presets, graphics, icons, images, and video files, are owned by Queenscliff Global LLC and its affiliates and protected by U.S. copyright law and international treaty provisions. Treat the product and its content as copyrighted material. We claim no rights in the images you produce with it.

Permitted Use
One named individual may install and run the RA Panels BETA on up to two (2) computers (for example, your studio desktop and a laptop). You may use it for any work, including paid client and commercial work, on the same terms as your RA Panel license. The license is personal to you and cannot be shared, rotated between people, or used by two people at once.
You may not share, rent, lease, sublicense, resell, redistribute, give away, or lend the RA Panels BETA; reverse engineer, decompile, modify, or create derivative works from it, except as expressly permitted by law; publish our scripts, actions, brushes, or tool presets as your own or inside another product; or circumvent or tamper with activation. Doing any of these ends the license immediately.
You may share screenshots, recordings, and your opinions of the BETA publicly. Please label them as BETA, since features may change before release.

Feedback
Please submit feedback, bug reports, and suggestions through the BETA page for that panel (for the Beauty Retouch 6.0 BETA, the Beauty Retouch 6.0 Beta page). We may use anything you send us about the BETA to improve our products, without any obligation or payment to you. Do not include client images or other confidential client material in your feedback.

Disclaimer Of Warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the BETA will work without interruption or error, or that any bug will be fixed. Nothing here limits consumer rights you hold under the mandatory law of your country.

Limitation Of Liability
To the fullest extent permitted by law, we are not liable for any incidental, indirect, special, or consequential damages, including lost work, lost data, or lost business, arising from the use of, or inability to use, the RA Panels BETA or its documentation, even if we have been advised of the possibility of such damages. Our total liability for the BETA is capped at what you paid for the corresponding RA Panel license. Nothing here limits consumer rights you hold under the mandatory law of your country.

Governing Law
This Agreement is governed by the laws of the State of Texas. If a court finds any part of it unenforceable, that part will be enforced as closely to its original intent as is legally possible, and the rest of the Agreement remains in full effect.
